1. Introduction

Welcome to LUNAEARN Agencies. These Terms and Conditions ("Terms") govern your use of our web development services and website. By accessing our services or making a payment, you agree to be bound by these Terms.

2. Services Offered

LUNAEARN Agencies provides professional web development services including:

• Personal Websites: Portfolio and personal blog websites
• Business Websites: Corporate and business websites with CMS
• E-commerce Solutions: Online stores with payment integration
• Custom Web Applications: Tailored web-based solutions
• Dashboard Solutions: Admin panels and analytics dashboards

3. Payment Terms

3.1 Deposit Requirements

All projects require an initial deposit payment to commence work:

• Basic Website: 40% deposit of total project cost ($140 deposit on $350 package)
• E-commerce Website: 40% deposit of total project cost ($248 deposit on $620 package)
• Custom Dashboard: 40% deposit of total project cost ($232 deposit on $580 package)

3.2 Payment Methods

We accept payments through:

• DPO Payment Gateway: Secure online payments in multiple currencies (Kenya, Uganda, Tanzania, Rwanda, Ghana, Zambia, South Africa, Malawi, Botswana, Namibia, UAE, and more)
• Manual Payments: M-Pesa, Airtel Money, and Bank Transfer via WhatsApp coordination

3.3 Currency and Exchange Rates

Prices are displayed in USD but can be paid in your local currency. Exchange rates are updated regularly and final amounts are calculated at the time of payment.

3.4 Refund Policy

Deposits are non-refundable once project work has commenced. However, we offer:

• Full refund if we fail to start the project within 7 days of deposit payment
• Partial refund (50% of deposit) if project is cancelled before 25% completion
• No refund after 25% project completion

4. Project Delivery

4.1 Timeline

Project timelines are as follows:

• Standard Timeline: As agreed in service package
• Rush Delivery: 50% faster (additional fee applies)
• Express Delivery: 70% faster (additional fee applies)

4.2 Revisions

Each package includes a specified number of revisions:

• Personal Websites: Up to 2 rounds of revisions
• Business Websites: Up to 3 rounds of revisions
• E-commerce/Custom: Up to 4 rounds of revisions
• Additional revisions may incur extra charges

4.3 Delays

Project delays may occur due to:

• Client feedback delays (more than 3 business days)
• Incomplete or unclear requirements
• Technical issues beyond our control
• Third-party service delays (hosting, domain registration, etc.)

5. Client Responsibilities

Clients are responsible for:

• Providing accurate project requirements and specifications
• Supplying necessary content, images, and materials
• Timely feedback and approvals
• Domain name and hosting arrangements (if not included in package)
• Complying with all applicable laws and regulations

6. Intellectual Property

6.1 Ownership

Upon full payment:

• Client receives full ownership of the delivered website/application
• Source code and design files are transferred to the client
• LUNAEARN Agencies retains the right to showcase the project in our portfolio

6.2 Third-Party Assets

Any third-party assets (plugins, themes, stock images) used remain the property of their respective owners and are licensed for use.

7. Warranties and Disclaimers

7.1 Service Warranty

We warrant that:

• Services will be performed with reasonable care and skill
• Delivered work will match agreed specifications
• 30-day bug fix warranty after project delivery

7.2 Disclaimers

We do not guarantee:

• Specific search engine rankings or traffic volumes
• Compatibility with all future browser/device updates
• Zero downtime or interruptions (dependent on hosting provider)
• Performance of third-party integrations beyond our control

8. Privacy and Data Protection

We are committed to protecting your privacy:

• Personal information is collected only for service delivery
• Data is stored securely and not shared with third parties without consent
• Payment information is processed through secure, PCI-compliant gateways
• Clients have the right to request deletion of their data

9. Limitation of Liability

LUNAEARN Agencies shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities
• Data loss due to hosting provider issues
• Damages exceeding the total amount paid for services

10. Termination

10.1 By Client

Clients may terminate the project with written notice. Refunds will be calculated based on work completed and our refund policy.

10.2 By LUNAEARN Agencies

We reserve the right to terminate services if:

• Client breaches these Terms
• Payment obligations are not met
• Client requests illegal or unethical work
• Abusive or unprofessional behavior towards our team

11. Support and Maintenance

Post-delivery support includes:

• Free Support Period: 30 days of bug fixes and technical support
• Extended Support: Available through separate maintenance contracts
• Updates & Upgrades: Charged separately unless included in maintenance plan

12. Dispute Resolution

In case of disputes:

• Parties will first attempt to resolve through good faith negotiation
• If unresolved, disputes will be handled through mediation
• Governed by the laws of Kenya
• Jurisdiction: Courts of Kenya

13. Changes to Terms

LUNAEARN Agencies reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of our services after changes constitutes acceptance of the modified Terms.
